Students of irony need look no further than the Fujifilm student awards. 'Penguin Books are looking for a new image to feature on the cover of Rachel Carson’s revolutionary work Silent Spring. Your brief is to take a photograph that captures the significance of this book’s subject: the human destruction of our environment'. Carson's seminal 1962 book warned how man was poisoning the environment, leading to the extinction of species. Fuji and Penguin's T&C's are the sort of noxious crud that is destroying the photographic ecosystem:-
13. Copyright remains the property of the photographer at all times but each entrant grants to the Promoter a non-exclusive, sub-licensable perpetual, royalty-free, world-wide licence to use, reproduce, modify, adapt, translate, publish, distribute and display any Entry submitted as part of this competition in any media now known or hereafter invented. Each entrant acknowledges that the Promoter may sub-license the rights in an Entry to Penguin Books Limited for use as part of a book cover and in any related advertising, marketing or publicity materials. If you do not want to grant these rights, please do not enter this competition.
It is not explained why Fuji/Penguin would require such wide-ranging rights from all entrants when ostensibly this competition is for the single use of a single winning photograph on a single edition of a single book. Don't touch with a hargepole, is our advice.
Students who find themselves encouraged to participate by their college lecturers or departments may find this clause interesting, too:
11. The college or university that submits the most entries will receive £250 worth of Fujifilm Professional film and 100 Penguin Classics titles for their library. The relevant college/university tutor will be allowed to choose their preferred type of film.
CoprightAction would very much like to hear of any colleges that are prepared to sell out their students' interests by promoting this rights-grabbing competition, or, alternatively, are prepared to advise students not to enter.
